Published justification

The Tender Notice for the original opportunity was published on 30th January 2023 on Find A Tender. It was not published on OJEU. Any reference to EU Directives are legacy from the Delta E-Sourcing template and should be ignored for the purposes of this Notice. Borough Council of Kings Lynn & West Norfolk ('the Council') having entered into a contract for the provisions of architectural services is intending to enter into a modified contract with the current provider by making use of Regulation 72 (b)(ii) of the Public Contracts Regulations 2015 (as amended).

Publisher note: Since award of the original tender the design has been subject to unforeseen changes to the scheme. The exploration of the site and its history along with the discovery in the Guildhall of the floor that Shakespeare performed on, have required significant redesign. The project is at high risk of not using its approved £8.1m Town's Fund budget. Any further delay will result in this budget being handed back as the project moves towards a 2027 revised completion. The Council believes that a change of service provider would cause significant inconvenience and substantial duplication of costs. The Council proposes to modify the current contract with the current provider until the end of the architectural design period, 08.01.2028 following the end of the defects period.
