Single Suppliers Technical Reasons
Published justification
The direct award is justified under Section 41 and Schedule 5, paragraph 6 of the Procurement Act 2023, on the basis that, due to an absence of competition for technical reasons, only Bruker UK Limited can supply the goods required and no reasonable alternative or substitute has been identified. This is because the requirement must remain compatible with APHA's existing MALDI Biotyper® platform, accredited more…procedures and validated laboratory workflows. The direct award is necessary to maintain continuity of diagnostic and research capability and to avoid the significant validation, implementation costs and operational risks associated with introducing an alternative system.

The Supplier shall respond to queries within one (1) working day of contact from the Buyer. The response provided, shall provide the Buyer with either a suitable resolution within two (2) working days or agree timescale for when the issue shall be resolved.
    • KPI 2: DeliverySupplier delivers the Equipment within the agreed date, as detailed in Section 5.3 of Annex 2 (Specification).
