Procedure rationaleThe Artillery Systems Team, part of the Ministry of Defence, intends to award a contract to BAE Systems. The contract will be for a last time buy of BAE System’s product ‘MPE-S Type 2 with SAASM’ (Miniature Programmable Lightweight GPS Receiver Engine with S being the SAASM (Selective Availability Anti Spoofing Module)). The order will be placed within the next month (September 2022) and has an estimated value of £500,000.00. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this contract is regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of this contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons. 1. This is because the consequences and impact of not undertaking this purchase are: a) BAE will sell the MPE-S Type 2 with SAASM to others as this was a last time buy in 2021 and. b) BAE are the only source of MPE-S Type 2 with SAASM’ as it is their proprietary product and falls under International Traffic of Arms Regulations (ITAR)
