Procedure rationaleAs the original equipment manufacturer, Lockheed Martin Corporation own the technical data required for any contractor to provide any level of support to the Lockheed Martin manufactured radar systems. Serco Limited and their sub-contractor Lockheed Martin Corporation are the only suppliers with the required expertise, specific know how and data to provide the in depth support required. Lockheed Martin Corporation have granted Serco Limited the necessary permissions to allow them access to the technical data to perform the requirement.
The Defence Equipment & Security Air Defence and Electronic Warfare Systems Delivery Team, part of the United Kingdom Ministry of Defence, intends to award the contract to Serco Limited for Contractor Logistic Support of Lockheed Martin Radar Systems. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a Contract Notice is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(b)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons. The technical data is controlled by the International Traffic in Arms Regulations and the United Kingdom Ministry of Defence does not have the rights to release the relevant technical data for the purposes of competitive tendering nor does it have access to the relevant software codes and/or compiler information necessary for another contractor to perform the contract. |
