Procedure rationaleThe Secretary of State for Defence intends to award a single source contract for up to 3 years plus two option single years up to a maximum total contract duration of 5 years to KDS Supernova Business Solutions & Consulting Ltd for the provision of British Forces Cyprus (BFC) Human Resources IT System (HRIS) maintenance, support and development.
In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 32(b)(ii) of the PCR 2015 because competition is absent for Technical Reasons.
The HRIS system is run on a System Applications and Products in Data Processing (SAP) application which is operated through prepaid Software User licences from the current SAP accredited supplier KDS Supernova Business Solutions & Consulting Ltd. It has been customised based on British Forces Cyprus (BFC) requirements to account for a range of employee terms and conditions. It is intended to let a single source contract with the current supplier to include, as a deliverable, the process by which information will be transferred from the Contractor to the Authority without the risk of a capability loss. It is critical, given the technical business, continuity risks, that HRIS remains operational at all times and the the contract is let single source on this occasion, mitigating the risks as described above. The new contract will ensure technical data will be captured and regularised for future contract processes.
This notice is not a request for expressions of interest so please do not apply to tender. This notice advises that the Authority has decided to negotiate a contract to be let in late 2022 on a single source basis and is published for reasons of transparency. |
