- Published justification
Aerospace's unique position as a Federally Funded Development and Research Centre (FFDRC) and their unique relationship with the US Government means they have access to non-commercially available data and technical expertise and are therefore prohibited from competing for work.
The applicable exemption regulation for this contract is PCR 2015 Regulation 32 Section 2 (b) (ii) 'competition is absent for technical reasons' as there is 'no reasonable alternative or substitute that exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement'.
