Procedure rationaleThe direct award is justified under Schedule 5 of the Procurement Act 2023, specifically where a contract may be awarded without competition where the goods or services can only be supplied by a particular supplier due to technical reasons or the protection of exclusive rights (including intellectual property rights). Leicester City Council currently owns 30 operational ANPR/enforcement camera sites supplied and installed by Yunex Traffic. These assets are proprietary systems developed and manufactured by Yunex Traffic and are protected by intellectual property rights relating to the hardware configuration, firmware, evidential processing software and system integration. The complete package of the camera and its associated software, systems and secure communications operate under VCA type approval meaning the evidential capture, calibration, data transmission and processing must be maintained in accordance with strict VCA certification requirements. Only Yunex Traffic has the technical authority, proprietary access and certified tools required to maintain our existing camera enforcement sites. This includes installing necessary firmware/security updates and replacing defective parts to maintain the VCA certification and ensure continued evidential compliance. No alternative supplier has access to the proprietary systems required to maintain these cameras without invalidating certification, breaching intellectual property rights or compromising evidential integrity. As such, no other suppliers can come forward to maintain these cameras due to these technical reasons and the protection of exclusive rights applies.
