Why no open competition: Urgency
Published justification: The services were strictly necessary in response to an urgent and unforeseen situation requiring immediate specialist financial and commercial advice. The circumstances giving rise to the requirement were not attributable to any act or omission of the contracting authority and could not reasonably have been foreseen. The urgency and associated timescales meant that the contract could not be awarded through a competitive tendering procedure, including using the shortened timescales available for urgent procurements. The contract was therefore directly awarded in accordance with Schedule 5, paragraphs 13 and 14 of the Procurement Act 2023.
