How bids were scored

Lots publish different evaluation splits; there is no single procedure weighting.

What this means for your bid
  • Price carries 70 points on every lot: a 10% discount moves about 7 points.
  • “Surgical Gowns single use, Theatre Scrub brushes & Headwear” is a framework: the contest is a place on its panel, up to 16 suppliers, not a single contract.

Price arithmetic assumes straight proportional scoring; the tender pack may use another formula.

Review procedure

Economic operators should approach the contracting authority in the first instance. However, the only formal remedy is to apply to the courts:

An economic operator that suffers, or is at risk of suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2015 or the Procurement Reform (Scotland) Act 2014, may bring proceedings in the Sheriff Court or the Court of Session.

The bringing of court proceedings against the Authority after the Framework Agreement has be entered into will not affect the Framework Agreement unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise the remedies that may be awarded by the courts where the Framework Agreement has been entered into are limited to the award of damages.

Publisher note: The Common Services Agency (more commonly known as National Services Scotland) (‘the Authority’) acting through its division National Procurement, is undertaking this procurement of (Surgical Gowns and headwear and scrub brushes surgical….) The estimated values referred to in Section II.I.5 and II.2.6 covers the 24 months contract duration and the 36 month extension period of the framework agreement. (SC Ref:802894)
