Procedure rationaleConsidering timescales and the complexity of the requirement, if the contract were not be extended in this instance, it is likely a gap in technical knowledge and capability would jeopardise the safe operation of the fleet of vehicles and would cause significant inconvenience or substantial duplication of costs for the contracting Authority.
The Authority continues with its intent to conduct a competitive procurement activity for the long term requirement, which is anticipated to be awarded prior to the completion of the extended period of performance.
It is considered that the contract can be extended in accordance with Article 2014/24/EU of the European Parliament and of the Council (Regulation 72(1)(b) of the Public Contracts Regulations 2015):
72.—(1) Contracts and framework agreements may be modified without a new procurement procedure in accordance with this Part in any of the following cases:—
(b)for additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor—
(ii)would cause significant inconvenience or substantial duplication of costs for the contracting authority, |
