Procedure rationaleThe required spare parts can only be procured from a single source, HARSH LTD. It is not considered appropriate or necessary to release competitions for specialist parts where there is no competitive marketplace. There are derogations under the Regulations to award a contract to a single supplier where the supplies or services can only be supplied by a particular supplier. Regulation 32(5)(b) of the Public Contract Regulations 2015 enables the Department to negotiate a contract directly with one or more economic operators, where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics, which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
