- Published justification
NIMDTA intends to directly award this contract to Nissin Dental Products Europe BV.
The Simodont platform is a proprietary dental simulation system developed and manufactured by Nissin. Nissin is the sole provider of manufacturer-authorised maintenance services, software updates, calibration procedures and OEM replacement components necessary for ongoing support of the installed equipment.
Following consideration of the market, NIMDTA has concluded that no reasonable alternative supplier can fulfil the technical requirements of the contract.
- Risks
The contract relates to the ongoing maintenance, technical support, software updates and repair support of the existing Simodont dental simulation equipment. Due to the specialist nature of this equipment and the proposed five-year contract duration, the following known risks have been identified which, if they materialise and cannot reasonably be addressed within the original contract terms, may require modification of the contract:
- Changes in manufacturer requirements or technical specifications: Changes introduced by the manufacturer to the Simodont equipment, associated hardware, software, operating systems or technical requirements may require alterations to the scope or method of maintenance and support required to ensure continued safe and effective operation.
- Software and technology changes: Updates, upgrades or changes to Simodont software, supporting software or associated technology may affect the maintenance and support requirements during the contract period. This may require changes to the services necessary to maintain compatibility and functionality.
- Availability or obsolescence of components: Specific components, replacement parts or associated technology may become obsolete, unavailable or superseded during the contract period. Alternative or replacement components, hardware or technical solutions may therefore be required to maintain the operational capability of the existing equipment.
- Unforeseen equipment deterioration or component failure: The age, usage and technical condition of the existing simulation equipment may result in failures or maintenance requirements that could not reasonably be fully identified at the point of contract award. This may require additional or alternative maintenance, repair or replacement of components to maintain satisfactory operation.
- Changes to manufacturer support arrangements: Changes to the manufacturer's technical support model, maintenance processes, repair arrangements or the availability of specialist technical expertise could affect how the contracted services are delivered and may require corresponding amendments to the service arrangements.
- External supply-chain disruption: Disruption affecting the manufacture, availability, transportation or delivery of specialist replacement parts or components may affect the supplier's ability to deliver the contracted maintenance and repair services in the manner originally anticipated.
Any modification arising from the materialisation of one of these risks would be limited to what is necessary to address that risk and maintain the satisfactory performance and continuity of the maintenance and support arrangements.
