Torbay Council is procuring a Healthy Ageing programme, focused on Torbay residents aged 50 years and above. The Live Longer Better programme is a targeted prevention offer to support older adults to take steps to optimise their physical, social, cognitive and mental health and wellbeing; in order to promote healthy life expectancy and reduce health inequalities.

    The Authority reserves the right to the following optional additional purchases while the contract is valid: Utilising the extension option available within the contract for a period of up to one (1) further year. Increasing the number of users who will access the service due to an increase in the wider geographical footprint which may be brought about due to the Local Government Reform. The absorption of other services currently outside of the Torbay geographical area including TUPE of staff which may be brought about due to the Local Government Reform. Changes to the Public Health ringfenced grant and/or additional grants prescribed to Torbay Council to administer which broadly fall under the scope of this Contract. Changes to service user needs meaning additional activities or services should be included, or services removed or adapted to meet evolving requirements of the population. The service evaluation may bring about changes to scope as a consequence to feedback received; this is to ensure services continue to meet the needs of service users and staff in the future. Service elements and deliverables described within the Specification may need to be adapted to meet any changes in legislation, NICE guidance, quality standards and/or best practice relating to services being provided under this Contract provided that those required changes do not affect the overall scope and nature of the contract. Exponential changes in the cost of living and/or inflation to ensure costs of service delivery can be afforded. Modifications may be required to maintain or adapt service delivery that results in different structures, delivery models, interventions, or other requirements (e.g. responsibility for commissioning Treating Tobacco Dependence is transferred from the NHS to the local authority). Future epidemics or pandemics may result in the requirement of the services to rapidly stand up, increase, suspend, or terminate contracted elements in response to these outbreaks, or equivalent issues. Changes will be evaluated on a case-by-case basis, and any additional costings or return of any accrued underspend would be agreed upon by both parties, ensuring the budget remains aligned with the revised scope of services including the return of any unrequired funds paid in advance. Please note that this list is not exhaustive, and a more detailed breakdown can be found in Schedule 10 Change Control Procedure of the Service Contract published alongside the tender pack. · The Contract may be extended for a period of up to one (1) further year, subject to termination clauses within Terms and Conditions of Contract and as provided for in section 78 Implied right to terminate public contracts of the Procurement Act 2023
