The purpose of this variation is to enable procurement of additional biogeochemical oceanographic sensors where the requirement for additional parameters has evolved since the initial contract was awarded. Following the award of a contract, changes (referred to as modifications in the Procurement Act 2023) sets out ten grounds in total on which public contracts may be modified during their term, provided the relevant requirements are met. The legal framework that governs contract modifications are set out in Sections 74-77 and Schedule 8 of the Act and regulation 40 regulate contract modifications. This contract variation is a 'permitted modification' under the grounds set out in Schedule 8 (section 74(1)(a)). This modification is permitted under Schedule 8 section 4 (1) (a), (b), and (c).
