Procedure rationaleThe Vehicle Support Team, part of the UK Ministry of Defence, intends to place a Contract with Pearson Engineering Limited (“the Contractor”) for the provision of technical advisory support to Front End Equipment used on the Terrier, Titan and Trojan Armoured vehicles, for a period of three years with a further 2 x 1 year options. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 for technical reasons. Only the contractor, as the Design Authority and Original Equipment Manufacturer of the Front End Equipment used on the Terrier, Titan and Trojan Armoured Vehicles has access to the technical information, and has the technical expertise, knowledge and know-how necessary to provide technical advice to the Safety and Environmental Management Panels (SEMP) to assure the safety of the equipment. This information is not available to the Authority as it is owned by the Contractor and the Authority does not have the necessary rights to that information to provide to any third party that would enable them to safely fulfil this requirement.
