NHS Essex Integrated Care Board (the Authority) intend to award multiple contracts for provision of Orthodontic Services (the Service) to the existing providers in Mid and South Essex and North East Essex following a direct award process C under the Provider Selection Regime 23.

The contract provides NHS primary care orthodontic services across Essex ICB, comprising the assessment and completion of orthodontic courses of treatment for eligible patients, including active treatment, supervised retention, early intervention and urgent care. Services are delivered by established specialist orthodontic providers under PDS arrangements, maintaining continuity of care, clinical quality and access for children and young people across the Essex system.

Extensions

These contracts have not yet formally been awarded; this notice serves as an intention to award under the PSR. The award decision-makers are: Essex Integrated Care Board Governing Board All individuals involved in the decision making process were required to complete conflicts of interest declarations in line with Regulation 21 of the PSR. Conflicts of interest declarations were received and reviewed for relevant officers. No actual, potential or perceived conflicts of interest relevant to these contract awards were identified. Where Declaration A was submitted, this was confirmed and recorded in the project conflicts register, which has been maintained as a live document and reviewed at key stages, including prior to publication of the transparency notice. Authorised Individuals oversaw the process, ensuring compliance with PSR requirements, appropriate separation of duties, and ongoing monitoring to ensure that any new or emerging conflicts would be declared promptly and managed proportionately. In making this decision, the relevant authority placed greatest weight on integration, collaboration and sustainability (30%) and quality and safety (25%), reflecting the clinically specialised, capacity constrained nature of orthodontic services and the critical importance of continuity of care for patients undergoing long term treatment. Value (20%) and access, inequalities and choice (20%) were also significant and were assessed primarily through the lens of avoiding disruption, protecting local capacity and preventing the duplication of costs associated with provider change, given nationally fixed pricing and limited market contestability. Social value (5%) was weighted lower due to the authority’s limited leverage in this niche market and the need for a proportionate, phased approach to additional requirements. The incumbent providers were selected because they demonstrably meet all regulatory and quality requirements, are embedded within local pathways, and offer the lowest risk option for maintaining safe, effective and equitable services, with any alternative provider selection route posing unacceptable risks to continuity, patient safety and system stability.
