Procedure rationaleAbsence of competition on technical grounds; it is affirmed that Uniphar Medtech UK Ltd are the exclusive supplier for the REBOA Catheter. Uniphar Medtech Ltd are the sole provider nominated by the OEM of the REBOA Catheter and associated goods for post sales Accessories & Consumables. The OEM (Prytime Medical Ltd) hold the IPR for the design of the equipment. They are also the Technical Authority for any changes applicable to the products. However, Prytime Medical does not retain exclusive distribution rights for the UK market. We intend to award to Uniphar Medtech UK Ltd under PA 2023 Schedule 5 Paragraphs 5 & 6 – Direct Award Justifications 5) The following conditions are met in relation to the public contract— (a) due to a particular supplier having intellectual property rights or other exclusive rights, only that supplier can supply the goods, services or works required, and (b) there are no reasonable alternatives to those goods, services or works. The following conditions are met in relation to the public contract— (a) due to an absence of competition for technical reasons, only one supplier can supply the goods, services or works required, and (b) there are no reasonable alternatives to those goods, services or works.
