  Under these conditions an extension can be permitted. Variations Related to Drilling Elements Where SOCOTEC considers that a change to the drilling scope, methodology, borehole depth, quantities, programme or other element of the Services is required, SOCOTEC shall promptly notify Peabody in writing, setting out; (a) the reason for the proposed change; (b) the impact on the Services; (c) any implications for health, safety or environmental compliance; (d) any proposed adjustment to the Fee; and (e) any impact on the programme. No variation shall be implemented, and no additional cost or extension of time shall be recoverable, unless and until Peabody has issued written approval. Where an immediate change is required to address an unforeseen health, safety or environmental risk, SOCOTEC may take such reasonable steps as are necessary to mitigate that risk, provided that Peabody is notified as soon as reasonably practicable and, in any event, within 24 hours. Any approved variation shall be valued using the rates set out in the Agreement or, where no applicable rates exist, on a fair and reasonable basis agreed between the parties.
