Why no open competition: The works, supplies or services can be provided only by a particular economic operator due to absence of competition for technical reasons; Extreme urgency brought about by events unforeseeable for the contracting authority/entity and in accordance with the strict conditions stated in the directive
Published justification: The EA One Project is currently implementing the
replacement solution for the existing payroll system.
To date 4 of the existing EA payrolls have transferred to
the new system. Following a Gateway Review
recommendation to extend the overall EA One
implementation plan to manage the risks involved with the
cutover of these complex payrolls.
The legacy payroll system is a completely bespoke
payroll solution built purely for the needs of the EA and DE
and their unique employment term & conditions (of which
there are over 270 variations.) The replacement solution has
been built to accommodate these complexities and will
eventually replace the current system. Therefore, the
current payroll system must stay in place until all payrolls of
EA and DE have transferred to the new solution.
There are no other suppliers in the market that could
provide an alternative payroll solution while the transfer to
the new solution completes.
