- Why no open competition
- Single Suppliers Intellectual Property Exclusive Rights; Single Suppliers Technical Reasons
- Published justification
Torus62 Developments Limited is making a direct award under Section 41 of the PA 23 because a direct award justification applies and the Supplier is not an excluded supplier.
Torus62 Developments Limited considers that the following conditions are met in relation to the public contract and therefore, the direct award justification set out in Schedule 5(6) of the PA23 can be relied on:
a) due to an absence of competition for technical reasons, only a particular supplier can supply the goods, services or works required; and
(b) there is no reasonable alternative to those goods, services or works.
The reasons why Torus62 Limited considers that this direct award justification applies is because:
(a) the Supplier is prepared to sell the land only as part of arrangements that also include its development.
(b) Torus62 Developments Limited has significant unmet need in the locality of the development, evidenced through long housing waiting lists.
(c) There is no other land on the market which is available for social housing development within reasonable timeframes local to the unmet need for development.
