Published requirement description

The NHS and NSS have invested in and deployed a range of cyber security tools across NHS boards through the Cyber Centre of Excellence (CCoE). These tools work together to reduce the risk and impact of cyber-attacks. While this approach has been successful and adds value, the residual risk is still high due to the nature of ransomware attacks:

  • Existing tools by their nature remediate reactively once they detect an attack to contain it, and
  • The risk of data being stolen prior to its encryption is now equal to – if not greater than – the encryption of the data itself.

Review and risk notes
Review procedure

Economic operators should approach the contracting authority in the first instance. However, the only formal remedy is to apply to the courts:

An economic operator that suffers, or is at risk of suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2015 or the Procurement Reform (Scotland) Act 2014, may bring proceedings in the Sheriff Court or the Court of Session.
