Procedure rationaleThe International Guns, Missiles and Rockets Project Team, part of the UK Ministry of Defence (MOD) intends to award a 16-month contract to Leonardo MW Ltd for In-Service Support (ISS) solution for the Gun System Automation Mk8 (GSA8), Gun-Fire Control System fitted to T23 Frigates from February 2023.
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful under Regulation 16 (1) (a)(ii) of the Defence and Security Public Contracts Regulations 2011. This is for technical reasons because following a call for competition, only one response to the contract notice (Notice reference: 2022/S 000-018057) was received from Leonardo MW Ltd. In absence of interests from other suppliers, Leonardo MW Ltd. is currently the only supplier with sufficient capability to deliver this requirement’. |
