Published justification

An urgent and unforeseeable situation arose that was outside the control of the Trust. There was an immediate requirement to meet a statutory financial deadline (outside of the UK) and there was insufficient time to undertake a competitive procurement process.

Failure to meet this deadline would have resulted in the loss of a significant financial recovery opportunity and potential financial detriment to the Trust.

The Trust considers that a direct award in accordance with PA23, Schedule 5 (13), was necessary to address the immediate requirement within the required timeframe, secure the financial recovery opportunity and protect public funds.
