- Published justification
The OPONI rely on a derogation, in this case 32 (2) (b) (iii), due to technical reasons as Clue Computing Ltd own exclusive rights to the IL5 security level system which has been heavily bespoked for OPONI and are the sole supplier for support, maintenance and licensing. In addition for the additional licences it OPONI will also rely on the provisions of Reg 32(2)(b)(ii) on the basis of the technical compatibility requirements.
- Review procedure
The Public Contract Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). The authority incorporated a standstill period (i.e a minimum of 10 calendar days) before this contract was awarded.
