Procurement method rationale- The services within the contract were deemed by the contracting authority to require expert technical and background knowledge of underpinning research methodologies from a 2022 study covering the data needs of UNESCO designated sites in the UK and Canada. - The contractor was considered to be uniquely placed with this knowledge within the wider data services market, as well as having specialist expertise and track record in delivering public data contracts. - Regulation 33(1)(b)(ii) - competition is absent for technical reasons was therefore considered to lawfully apply. - A direct appointment without prior publication of a call for a competitive commission was considered acceptable by senior management at the contracting authority and the decision was verified independently by an external project Steering Group. - It was concluded that the level of specific expertise demanded meant better value for money in terms of quality and cost was unlikely to be met via a competitive approach. - A negotiated procedure secured best value for money for the services by the contractor, including a 12% discount on its published public sector rates.
