Why no open competition: The procurement falls outside the scope of application of the directive
Published justification: To ensure continuity of service to the General Teaching Council Northern Ireland for their critical business functions whilst the requirement is retendered, it is permissible to rely on regulation 72(1)(c) -The need for the change could not have been foreseen by a “diligent” Department provided the changes do not affect the overall nature of the contract or exceed 50% of the value of the original contract value.

Review and risk notes
