Why no open competition
Single Suppliers Technical Reasons; Additional Repeat Extension Partial Replacement
Published justification

It has been determined that in current circumstances that competition is absent for technical reasons pursuant to Schedule 5 paragraph 5(a)(b) and 7(a)(b) of the Procurement Act 2023. Justification for the award is as follows:

The Contract includes the provision of proprietary software, firmware and embedded components with intellectual property rights owned by the original equipment manufacturer (OEM) – Schneider Electric Systems UK Limited. A change in supplier would result in the contract authority receiving software/goods that are different from, or incompatible with, the existing works and using alternative suppliers could invalidate warranties controlled by the OEM. Changing suppliers would require reverse engineering, revalidation, and potential compatibility issues which could impact Sellafield's ability to operate its existing control systems.

The OEM maintains site and system specific technical knowledge and history of the existing Schneider Electrical Systems UK Ltd equipment installed on the Sellafield site.
