Procedure rationaleThe Contracting Authority intends to rely on the Single Supplier direct award justification, as set out in Paragraph 6 of Schedule 5 of the Act, to award a public contract directly to the CAA, a supplier that is not an excluded supplier.
The CAA is uniquely positioned and mandated to provide the required civil oversight for military registered aircraft derived from civil type designs. Key technical justification points for this contract include:
• Regulatory Requirement:
Under MAA RA 1165, civil derived aircraft operating on the Military Register must be subject to oversight by the CAA. No other body is authorised to provide this specific oversight.
• Assurance of Type Airworthiness:
The UKMFTS Training Aircraft Chief Engineer – Type Airworthiness Authority (TA CE(TAA)) relies on direct evidence from the CAA to assure Type Airworthiness. Without this, the aircraft cannot legally or safely remain in service.
• Platform Integrity Requirements:
Under MAA RA 5726, the CAA is identified as a key stakeholder in maintaining Platform Integrity. Their participation in organisational and management processes is mandatory.
• Use of Civil Spares Pools & Re Registration:
Continued CAA oversight enables access to the civil spares pool and maintains the ability to transition platforms back to the Civil Aircraft Register.
Accordingly, due to an absence of competition for technical reasons, the CAA is considered as the only supplier that can provide the services and there are no reasonable alternatives to those services as required by the Authority. |
