A competitive PSR process would have delayed mobilisation and resulted in longer patient waits, undermining NHS England recovery requirements, including progress against 52‑week and 65‑week waits.
Publisher note: This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selector Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. Justification for this award is that without urgent intervention, waiting times would excessively exceed parameters set. Patients would have experienced delayed procedures, resulting in extended waits and increased 52 and 65 week breaches. Delays to planned treatment increase the risk of deterioration in patients' clinical condition, pain, anxiety and avoidable emergency admissions. Alternative providers could not realistically mobilise full weekend theatre teams within the required timeframe. Xyla was able to mobilise at pace based on prior experience and workforce availability. The decision was made by Trust Board as well as the Chief Operating Officer There are no conflicts of interest.
