Published requirement description

NHS England is seeking a supplier for the provision of:

  2. A national implementation delivery plan for the JE DS, including pilot, phased rollout and training arrangements for relevant NHS staff.
  3. Ongoing JE DS maintenance, updates, user support and training updates throughout the contract term.

Review and risk notes
Risks

Known Known Risks

  • Additional Services: Any optional services allowed in the contract that we may need to use from time to time
  • Termination Assistance Notice: Termination assistance notice provisions in the contract that allow us to extend the contract to facilitate transition to a new contractor (including continuing to provide services in the interim)
  • Procurement Delays: A delay during a procurement process that has meant that the procurement of a replacement provider is taking longer than we could have reasonably predicted
  • A change in the number of offices, sites or NHS organisations that might lead to more/less services
  • Change to the number of Licences required: the number of licences may need to be increased or decreased to take account of changing numbers in employees

Known Unknown Risks

  • Legislative Changes: New laws governing e.g. health and safety standards, data protection etc. are due to be introduced, but the changes needed to comply are not known until the laws are fully defined.
  • Changes to standards if changes to standards (e.g. BSI, ISO, etc): Licence pass through costs Curriculum or Qualification Updates Changes to NICE (or similar) guidance may require existing Facilities & Estates Changes to these standards could impact
  • Changes in Ministerial Commitments: If the Minister announces new commitments which impact the deliverables under the contract, or may be best dealt with as an additional service under this contract, taking into account the public interest test
  • Emerging Cyber Threats: If a cyber threat emerges, NHSE may need to make changes to the deliverables and/or the provision of ancillary services to enable systems to operate safely and adequately protect personal information stored on the system.
  • New technology: New technology arises that would provide better VFM, security, might be ancillary to the technology provided under the contract.
  • Target Architecture: Target Architecture proves not fit for purpose (but only came apparent on the first roll-out). Will need re-engineering, which will incur unforeseen costs and delays.
  • IPR Infringements Legal challenge of improper use of third party owned IP
  • Global supply chain constraints for hardware – lack of availability of certain materials required for hardware production due to global issues (e.g. rare earth elements required for production microchips).
