Procedure rationale“The Air Commodities Team, part of the UK Ministry of Defence (“the Authority”) intends to extend the existing contract ACCOMM/000100 with JBT Aerotech UK Limited for the Post Design Services (PDS), Spares and Repairs for the Atlas, DIS and DDIS Trailers from 31st Dec 21 to 30th Jun 23, in order to maintain an interim solution whilst negotiating a Single Source future contract. The VTN for the future contract will be published under separate cover via the Defence Sourcing Portal prior to 30th Jun 23. It is considered that the contract can be extended using the negotiated procedure without prior publication of a contract notice pursuant to Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons, the contract may be awarded only to this particular economic operator. The reasons for this are as follows: JBT Aerotech UK Limited is the Original Equipment Manufacturer (OEM) for Atlas Aircraft Loader and DDIS Trailers – These are prime vehicles of choice by Front Line Command for deployment to move consignments of freight, and for on/off aircraft loading. The Atlas Loader and DDIS is viewed as a Force Multiplier, should this asset not be available it would severely limit or jeopardise planned and future aircraft freight movement. JBT Aerotech UK Limited hold exclusive intellectual property rights and proprietary information in the form of the documentation setting out the manufacture of the equipment, which is unavailable to other economic operators. Alternative providers would therefore be unable to replicate spare parts for the Atlas Aircraft Loader and DDIS Trailers with any certainty. Therefore this requirement can only be met safely by the OEM JBT Aerotech UK Limited. For these reasons, the specialist skills, know-how and technical information required, this equipment would not be available from an alternative supplier. As a result, JBT Aerotech UK Limited is the only company able to fulfil the requirement that is being pursued by the Authority.
