Transport Scotland has identified the requirement to appoint a suitably experienced Contractor to design & build a new dual carriageway from a point approximately 1km south of the existing Tummel underbridge near Pitlochry, to the southern end of the existing dual carriageway at the Pass of Killiecrankie.\nThe contract will include a 260 week period of maintenance after completion of the main works and a 260 week period of landscape establishment following completion of landscape planting. The Contractor will not be required to carry out cyclic maintenance, which shall be carried out by a third party appointed by the Scottish Ministers.\nThe Contractor will be procured through a Competitive Dialogue procedure, in accordance with the Public Contracts (Scotland) Regulations 2015. Transport Scotland will manage the proposed procurement process for the A9 Dualling Pitlochry to Killiecrankie Contract on behalf of the Scottish Ministers.\nIn the event of a Contract award, the Contract will be entered into between the Scottish Ministers and the successful tenderer.\nThe procurement process leading to the award of the Contract will comprise the following:\n1. Prequalification (SPD) (approx. 6 weeks)\n2. Competitive Dialogue (approx. 33 weeks)\n3. Tender (approx. 6 weeks)\n4. Award\nDetailed information regarding the award process and award criteria for the tender phase will be supplied to economic operators who are invited to participate in dialogue.\nTransport Scotland shall notify Participants when the Competitive Dialogue phase has concluded and invite the Participants who have presented an acceptable solution to submit a final tender.\nThe form of contract is to be an NEC4 Engineering and Construction Contract (ECC) Option A: priced contract with activity schedule with amendments. Additionally, there will be an employer’s design with a re-measurable bill of quantities for maintenance works associated with the existing Tummel Bridge.\nContract documentation will be provided at Invitation to Participate in Dialogue (ITPD) stage to shortlisted participants, however the DRAFT conditions of contract will be made available for all economic operators to review within the Information Pack. Refer to Section VI.3) for further information on how to access to the Information Pack.\nTransport Scotland is providing a DRAFT of its conditions of contract to ensure prospective economic operators are informed as early as possible of the contract.           "minimum": "Economic operators shall be required to satisfy minimum standards of economic and financial standing. These are described below:\nEvaluation Criteria Ratios (SPD Question Ref. 4B.6)\nThe following nine evaluation criteria shall be scored, for each year of the last two years of trading, or for the period which is available if trading for less than two years:\n1. Acid Test Ratio\n2. Cash Interest Cover Ratio\n3. Return on Capital Employed\n4. Operating Profit Ratio\n5. Net Worth\n6. Gearing\n7. Annual Contract Value to Turnover\n8. Filed Accounts\n9. Audit Report\nThe scoring mechanism can be located within the Supplementary Information Document and downloaded via the Additional Documents, located within the Additional Notice Options of the Public Contracts Scotland portal (www.publiccontractsscotland.gov.uk). For the purpose of calculating the Annual Contract Value to Turnover ratio the estimated value in II.2.6 of this Contract Notice shall be adopted. Similarly, for the purposes of this ratio, the duration of the contract (construction phase) shall be approximately 4 years. This equates to an estimated value of 51,000,000 GBP per annum for the initial construction phase, followed by an estimated value of 200,000 GBP per annum for the subsequent maintenance phase (60 months).\nThe nine evaluation criteria will be individually scored and given a total aggregated score, out of a possible 50 marks, for each year of trading. Subsequently, each year’s score will be weighted, with the most recent (“Year 1”) weighted at 2/3rds and the previous (“Year 2”) weighted at 1/3rd, and then aggregated to form an overall score for the two years out of 50 marks.\nIf the economic operator is trading for less than 2 years, their financial ratios for the most recent full year of trading will be weighted at 2/3rds scored out of the total 50 marks. If the economic operator is trading for less than 1 year the information provided under III.1.2) b), will be prorated up to 1 year to calculate financial ratios for the full year and this will be weighted at 2/3rds and scored out of the total 50 marks.\nA submission shall be marked as a FAIL and will not be considered further if the score achieved by an economic operator (either a single economic operator or a group of economic operators) is less than 25 marks, out of the potential total aggregated score of 50 marks.\nA submission shall be marked as a FAIL and will not be considered further if the economic operator is unable to provide appropriate information to enable the calculation of the financial ratios.\nWhere the submission has been submitted by a group of economic operators, the information submitted by each group member will be evaluated in the proportion of the percentage shareholdings or percentage equity/interest of each group member and a score determined for such group of economic operators on that basis.\nA “group of economic operators” is defined as an unincorporated consortium or joint venture.\nInsurance (SPD Question Ref. 4B.5)\nIn response to SPD Question Ref. 4B.5, economic operators must confirm they already have or can commit to obtain, prior to the commencement, the following levels of insurance:\nProfessional Indemnity Insurance = GBP 10 million\nPublic Liability Insurance = GBP 155 million\nEmployer’s (Compulsory) Liability Insurance = GBP 10 million\nIn responding to SPD Question Ref. 4B.5, where the economic operator responds “No, and I cannot commit to obtain it” they shall be marked as FAIL and shall be excluded from this procurement competition.",

Note there will, however, be a negative scoring implication as noted below and in the Additional Documents.\nThis information has been requested to enable Transport Scotland to perform their own assessment and confirm the financial ratios submitted. Ultimately, ensuring the correct score is allocated, and to ensure no misinterpretation. Where there exist differences in ratios, between those provided and those calculated by Transport Scotland, clarification will be sought."

Transport Scotland has identified the requirement to appoint a suitably experienced Contractor to design and build a new dual carriageway from a point approximately 1km south of the existing Tummel underbridge, to the southern end of the existing dual carriageway at the Pass of Killiecrankie.\nTransport Scotland will conduct the proposed procurement process on behalf of the Scottish Ministers in accordance with the Public Contract (Scotland) Regulations 2015. In the event of a contract award, the contract will be entered into between the Scottish Ministers and the successful tenderer. The contract will include a 260 week period of defects and maintenance after completion of the main works and a 260 week period of landscape establishment following completion of landscape planting. The successful tenderer will not be required to carry out cyclic maintenance, which shall be carried out by a third party appointed by the Scottish Ministers. In the event of a contract award, the appointed contractor and the applicable subcontractors shall be required to enter into a Project Bank Account Trust Agreement. The Project Bank Account will be used by Transport Scotland to make payments.     "description": "The Scope involves the design, construction, completion and landscape maintenance of the proposed A9 Dualling: Pitlochry to Killiecrankie project.\nThe project will be the fifth section of the A9 Dualling Programme to be constructed, which aims to improve the operational performance of the A9, improve safety for motorised and non-motorised users, facilitate active travel within the corridor, and improve integration with Public Transport Facilities. The objectives are to be met whilst avoiding and/or reducing environmental impacts, enhancing the environment and improving sustainability where possible.\nThe Project involves the dualling of approximately four miles (6.4km) of existing single carriageway. This consists of approximately 4km of online widening and approximately 2km of offline construction. The project commences approximately 1km south of the existing Tummel underbridge and ends at the existing dual carriageway at the Pass of Killiecrankie. This section of the A9 is located in a rural area within close proximity to a number of designated environmental sites, such as the River Tay Special Area of Conservation (SAC) including the River Tummel and Loch Faskally, which are crossed by the existing A9.\nIn particular, the project involves, but is not limited to:\n-\tWidening of existing A9 single carriageway to Dual 2 lane All-purpose roads Sub-category c (D2APc) standard, in accordance with ‘CD 109 Highway Link Design’ within the UK Design Manual for Roads and Bridges.\n-\tUpgrades to the existing Pitlochry South Junction and Pitlochry North at-grade Junction to fully grade separated junctions.\n-\tConstruction of two left-in left-out junctions at C452 Foss Road and C452 Clunie-Foss Road.\n-\tUpgrade to side roads including resurfacing or realignment and other improvements.\n-\tConstruction of access roads to rural properties and businesses, including a further two left-in/left-out junctions onto the A9 with one at Pitlochry Estate and one at Kennel Cottage.\n-\tA Type-A Lay-by, which will provide physical segregation between the main carriageway and the lay-by, located on the northbound side of the A9, near the Tummel underbridge.\n-\tDemolition and replacement of three existing underbridges; Clunie-Foss Bridge, Foss Road Bridge and Craighulan Bridge.\n-\tA new underbridge at the River Tummel (Tummel underbridge) to accommodate the proposed A9 northbound carriageway.\n-\tA new underbridge at Loch Faskally (Clunie underbridge) to accommodate the proposed A9 southbound carriageway.\n-\tAn extension of one existing rail underbridge and one new rail underbridge.\n-\tProvision of five other new underbridges/underpasses, six new retaining walls and 15 culverts.\n-\tBearing replacement and concrete repairs to piers at the existing Tummel underbridge.\n-\tEarthworks, including excavation of rock.\n-\tReplacement and/or upgrade to a number of existing structures including culverts and Sustainable Drainage Systems (SuDS) developed in consultation with Scottish Environment Protection Agency (SEPA).\n-\tProvision of traffic management, road restraint systems, accommodation works, service diversions, fencing, signage, landscaping and environmental mitigation.",
