Procedure rationaleIn line with Schedule 5 – Direct Award Justifications, Paragraph 7 “Additional or repeat goods, services or works” of the Procurement Act 2023, this Direct Award is compliant on the basis that the requirement constitutes repeat services where a change of Supplier would result in Clarion receiving services that are different from, or incompatible with, the existing services, leading to disproportionate technical difficulties in operation and maintenance. The incumbent Supplier currently delivers Clarion's cyber security services and has developed extensive knowledge of Clarion's cyber security environment. The Supplier has established integrations with Clarion's critical systems and has the operational knowledge to maintain the existing service without interruption. A change of Supplier would create disproportionate technical and operational difficulties, due to requiring an extensive knowledge transfer, creating risks to service continuity and heightened cyber security risks while the new Supplier embeds and develops an understanding of Clarion's environment and risk profile. The Contract for this requirement was signed on 30/06/2026 due to the urgency of ensuring continuous service provision. Please note, I have included date of Contract signature in order to be open and transparent, as when the form is uploaded onto Atamis/ FTS it will require us to include future dates for Contract signature, etc. which are not accurate. This does constitute a risk as it highlights that the Contract has been signed prior to the Notice, but I feel this is the most appropriate approach.
