This direct award of an Interim Contract is justifiable under Schedule 5, paragraphs 13 and 14 of the Procurement Act 2023 (PA23) (the Interim Contract), on grounds of extreme and unavoidable urgency. Under the Interim Contract, following acceptance into service, maintenance services will be provided by Frequentis and Octave (the Sub-contractors/-contracts). These Sub-contracts are for maintenance of software components which are subject to exclusive rights and locked-in rates to ensure value for money. The Sub-Contracts have a term of ten years after exit from the Interim Contract (targeted for 9-months post go live of final production release 'Drop 3').
